Terms of Use
By creating an account or accessing the Cofamly application ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.
Article 1 – Information on Cofamly
1.1. Service Provider
The Cofamly application and the website https://www.cofamly.app (hereinafter the "App") are administered and operated by Ergane Commv (hereinafter "Cofamly" or "We"), having its registered offices in Belgium.

1.2. General Terms
Access to and use of the App are subject to these General Terms of Use (the "Terms") and the Privacy Policy, as well as Belgian law. Accessing the App implies the user's full consent without reservation to these Terms.
Cofamly reserves the right to modify and update these Terms at any time without prior notification. Modifications are effective immediately upon posting. We recommend consulting them regularly.
1.3. Third-Party Applications
The App may integrate third-party services (e.g., payment processors, calendar integrations). These applications are subject to their own terms and privacy policies, which are not controlled by Cofamly.
Article 2 – Content of the Service
2.1. General Description
Cofamly is a mobile platform designed to assist separated parents and families in organizing their daily lives with the child's well-being as the central focus.
To this end, Cofamly provides tools including, but not limited to:
- Cofamly Loops: A structured space for factual updates (school, health, mood) to reduce emotional conflict.
- Cofamly Agenda: A planning tool where appointments are strictly linked to a child to prevent confusion.
- Cofamly Split: A transparent system to track and balance child-related expenses.
- External Access: The ability to grant "read-only" access to third parties (e.g., mediators, grandparents).
2.2. Access, Pricing, and Subscriptions
A. Introductory Free Period
Currently, access to Cofamly is provided free of charge as part of our launch and introductory phase. Users may access core features (Loops, Agenda, Split) without a subscription.
B. Future Paid Services
Cofamly reserves the right to transition to a subscription-based model or introduce Premium features in the future.
- Notification: Users will be notified reasonably in advance if any currently free features will become paid features. You will never be charged without your explicit consent and entry of payment details.
- Subscription Terms: Once a paid model is introduced, subscriptions will automatically renew for the same period unless terminated by the Member prior to the expiry date via their account settings. Payments will be processed securely via third-party providers (e.g., Apple App Store, Google Play).
Article 3 – Electronic Agreement
3.1. Immediate Execution (For Future Paid Subscriptions)
In the event that the Member subscribes to a future paid plan, the Member accepts that the provision of the Service starts immediately. Consequently, the Member acknowledges that they may not exercise the right of withdrawal (cooling-off period) once the digital service has begun, in accordance with applicable consumer protection laws.
Article 4 – Member Status
4.1. Registration
Registration is reserved for natural persons aged 18 or older with full legal capacity. The Member is responsible for all activity occurring under their account, including access given to co-parents or third parties (mediators, family).
4.2. Member Obligations
The Member agrees to use Cofamly specifically for its intended purpose: constructive, child-centered organization. The Member agrees not to use the platform for harassment, abuse, or sending harmful content.
- Security: You are responsible for keeping your credentials confidential.
- Accuracy: You must ensure that the information provided (e.g., expenses, schedules) is accurate.
4.3. Content and Responsibility
The Member is solely responsible for the content (text, photos, financial data) uploaded to the App. Cofamly acts as a host and does not exercise editorial control over private family communications.
- You warrant that you have the necessary rights to upload any content (e.g., photos of children).
- Cofamly reserves the right to suspend accounts that violate these Terms or use the platform to harm others.
4.4. Refund Policy
For any future payments made to Cofamly:
Generally, payments made are non-refundable due to the immediate digital nature of the service.
- Exceptions: Refunds may be considered if a technical error on our part prevents proper use of the service, provided you have contacted support and we are unable to resolve the issue within a reasonable time.
- No Refunds for: Change of mind, uninstallation without cancellation, or features not explicitly promised.
Article 5 – Intellectual Property
The Cofamly App, including its code, design, logos, and structure, is the property of Ergane Commv. Users are granted a non-exclusive, non-transferable license to use the App for personal, family management purposes. You may not copy, reverse engineer, or use the content for commercial purposes.
Article 6 – Limitation of Liability
6.1. Availability
Cofamly strives to keep the Service available 24/7 but cannot guarantee it will be free from interruptions, bugs, or maintenance downtime. We are not liable for any loss resulting from the temporary unavailability of the App.
6.2. Use of Service
The App is a tool to facilitate organization; it does not replace legal agreements or court orders. Cofamly is not responsible for disputes arising between co-parents regarding the content shared (e.g., disputed expenses or missed appointments).
Article 7 – Applicable Law
These Terms are governed by the laws of Belgium. Any dispute relating to the validity, interpretation, or performance of these Terms shall be subject to the exclusive jurisdiction of the courts of the judicial district where Cofamly (Ergane Commv) has its registered office.
Summary of Changes made for the "Free-to-Paid" Strategy:
- Article 2.2 Split: I separated this into A. Introductory Free Period (to make it clear they don't pay now) and B. Future Paid Services (to protect your right to charge later).
- Explicit Consent: I added a line in 2.2 saying "You will never be charged without your explicit consent." This builds trust—users won't fear a surprise bill just because they signed up while it was free.
- Conditional Language: In Article 3.1 and 4.4, I added qualifiers like "In the event that..." and "For any future payments..." so these clauses remain legally valid but dormant until you actually start charging.
